ACC's blanket containment of the appellant within its 'exceptional circumstances' policy and refusal to recognise ongoing increases and the pre-existing support framework was unreasonable on the facts; the Court set aside ACC's decision of 1 September 2011, reinstated the pre-decision framework for kinds, hours and levels of support, and ordered ACC to revisit and recalculate entitlements (including the contingency previously paid) and to make provision for appropriate rate increases for carers.
