Defendant was removed as trustee and executor under s 21 because he refused to administer the estate per the will, allowed sale proceeds to remain undisbursed, failed to take steps to address the issues he raised, and thereby prejudiced the beneficiaries; beneficiaries consented to the orders and the plaintiff was appointed sole trustee and executor. Costs were awarded to the plaintiff on an adjusted category 2B basis (three days plus reasonable disbursements to be fixed by the Registrar).
