ACC lawfully declined to fund purchase/modification because the claimant failed to show the new small vehicle was necessary as a direct consequence of her covered injury and a suitable existing vehicle (the Nissan Cefiro) could be modified, while her ability to drive safely remained in doubt under Clause 21(4); therefore ACC's discretionary decision was correctly exercised and must be confirmed.
