Although WTL achieved the practical outcome (MC's withdrawal), costs lie where they fall because WTL failed to reasonably explore informal resolution, the application was unnecessary in the circumstances and MC acted reasonably and pragmatically in withdrawing to avoid prejudicing the substantive bankruptcy proceedings.
