The plaintiffs established a good arguable case, that the first defendant's Seatoun property was an asset within the Court's jurisdiction and that there was a real risk of dissipation because the property was on the market and the defendant proposed to leave employment to care overseas; rather than restrain sale, the appropriate remedy was to require NZD 150,000 of the net sale proceeds to be held without deduction in the first defendant's solicitors' trust account pending further order.
