On the balance of probabilities the plaintiff proved the testator had testamentary capacity in February 2010 (including sufficient understanding of moral claims); the direct contemporaneous evidence of treating clinicians, hospice staff, the Public Trust officer and friends outweighed hypothetical risks identified by defendants' expert; there was no cogent evidence of undue influence; probate in solemn form granted.
