On the totality of the evidence the Court was satisfied the testatrix knew and approved the 2011 will and that the plaintiffs did not prove undue influence by Brett; however the Court found a breach of moral duty to Neil under the Family Protection Act and ordered a modest monetary adjustment so that, with the Awanui property, Neil receives one-third of the estate excluding Brett's legacy (approximately NZD 40,000).
