Because the defendants applied for a stay of that part of Judgment (No 5) and the plaintiffs did not oppose the stay in principle, the Court granted a stay of execution of the order requiring sworn affidavits of documents pending the outcome of the appeal and made no order as to costs.

Because there is no record of any order entering the matter on the fast track and the appellants successfully opposed that application, they are entitled to costs of $669 for the memoranda opposing fast track entry; because the respondents' objection to counsel appearing lacked merit it was reasonable for the appellants to file written responses and they are entitled to $892 for those memoranda; taking agreed calculations into account the respondents must pay the stated totals to the respective appellants.

The application for an interim injunction to halt the Resource Management Act consent process was refused: although there are serious questions to be tried about some deed amendments and the trustees' exercise of power, the balance of convenience and overall justice favour allowing the RMA process to continue subject to undertakings and procedural directions; the High Court will manage and fast-track the trust litigation to align with RMA hearings and preserve overall justice.
