The Court of Appeal held the panel convener had lawful discretion to refuse to appoint an iwi-nominated member if the nominee's past misconduct and current suspension were relevant to fitness for office and to maintaining public confidence in the quasi-judicial panel; the convener was entitled to proceed under sch 5 cl 3(5) to appoint without an iwi nominee where appropriate, and the High Court erred by substituting its own assessment for the convener's judgment.
