The Court held that while the Corporation's policy criteria for assessing self-employment were valid, the Corporation failed to make necessary inquiries and take into account relevant facts (notably franchisor support, experience of existing franchisees and a full financial assessment) affecting critical criteria; therefore the decision to refuse funding was set aside and the matter was remitted to the Corporation for further fact-finding and reassessment under s23.
