On the balance of probabilities the respondent's later orthopaedic diagnosis (ruptured ACL and probable lateral meniscal tear), together with contemporaneous lay witness statements and employer notification, establish that the injury occurred on 6 March 2002 and caused incapacity on 7 and 8 March 2002; therefore the appellant was an earner at the time of first incapacity and entitled to weekly compensation for the period claimed.
