Where a guarantor settles and acquires secured property in good faith relying on genuine professional valuations and negotiations, he is entitled to seek contribution from co-guarantors; because the court found the plaintiff did not act improperly or contrive an undervalue purchase, contribution is payable on an equal-share basis subject to adjustments for insolvency or inability to pay.

The Court ordered an updated registered valuation to be obtained (costs to be shared equally) to provide a recommended listing and reserve price, with the parties given five working days to agree a valuer or have one appointed by the President or Senior Officer of the Manawatu Branch of the New Zealand Law Society; leave granted to either party to return on 48 hours notice for further directions and costs reserved, because there was insufficient evidence of obstructive conduct and changed market conditions warranted an updated valuation before varying substantive sale orders.
