Although the guarantee contained a forged signature, the fourth defendant had known of the forgery well before the claim and failed to inform the plaintiff; the plaintiff acted reasonably in seeking and maintaining the freezing order while it investigated the forgery; consequently indemnity costs were not justified and the plaintiff was entitled to scale costs on a 2B basis against the fourth defendant.
