The original handwritten document, notwithstanding non-compliance with s11 and the presence of erasures/strikethroughs, expresses Barry Benjamin Carr's testamentary intentions; the handwriting, location with other important papers, specificity of gifts and surrounding evidence satisfy s14 Wills Act 2007 and warrant a declaration that the document is his valid will.

The document prepared in March 2011 satisfied the statutory criteria in s14 (it appeared to be a will, originated in New Zealand, and expressed the deceased's testamentary intentions) despite non‑compliance with s11, and there was no evidence of changed intention or opposition; accordingly the document was declared the valid last will of Brian Anthony.

The documents were declared valid codicils under s14 because, on the balance of probabilities and given the context and unanimous consent of affected beneficiaries (and the declination by the mistakenly named trustee), the notes manifested the deceased's testamentary intentions despite non‑compliance with s11.
