On the summary application the applicants' affidavits, viewed in context and notwithstanding credibility criticisms, disclose a reasonably arguable case that the respondent accepted title on trust and that the applicants provided funds used to discharge the prior mortgage such that the caveat protects an arguable beneficial interest; accordingly the caveat should not lapse pending substantive proceedings, subject to strict conditions.
