On the affidavit evidence and uncontested material the Court was satisfied the defendants acted in concert to convert Worldclear's funds and that Retail Guru received specific diverted sums (NZ$50,000 and US$250,000 (NZ$382,965.68)); accordingly judgment was entered against Retail Guru for those amounts and costs were awarded to the plaintiff.
