Although there is a presumption in favour of access under High Court Rules r3.9 and the public interest in reporting under NZBORA s14, those interests were satisfied by access to the anonymised hearing and judgment; the child's and family's privacy interests in detailed medical information protected by s139 of the Care of Children Act prevail, and therefore the application for access to the court file was declined.
