The Court held that all challenged parole conditions except Corrections' detailed reintegration programme were authorised by s15(2) of the Parole Act and were reasonable and justifiable under s5 NZBORA; Corrections' reintegration programme as drafted exceeded the Board's authorised conditions, risked de facto detention and likely breached NZBORA, and must be remitted to the Parole Board for reconsideration.
