The High Court has jurisdiction to hear the s47 PRA claim in this case because the dispute involves third party rights and claims against property that would defeat third party creditors; that jurisdiction is concurrent with the Family Court so long as the High Court does not attempt to perform the core function of dividing relationship property under s25(1); accordingly the interim freezing orders were properly made and may remain in force.
