The Court found the building had systemic leaky damage, a court‑settled scheme was appropriate to ensure fair, uniform remediation and administration, and the proposed scheme's detailed terms and funding arrangements represented reasonable and necessary departures from the Act; accordingly the scheme was settled under s74 Unit Titles Act 2010.
