The court found that the plaintiff repeatedly failed to comply with timetabling directions, which caused Southern Response to file unnecessary memoranda and incur wasted steps; accordingly Southern Response was entitled to a wasted costs award of $3,345, but enforcement of that award was stayed until the plaintiff's insurance entitlements against both defendants are resolved.
