The Official Assignee failed to make adequate enquiries and did not turn his mind to the company's GST status when settling and accepting the consent orders; there was no qualifying mistake that would justify setting aside or varying the consent orders in the interests of justice. The consent orders should be enforced and, under the Court's powers to give directions in receivership matters, the Official Assignee was directed to pay the remaining $1.75m balance to the receivers; the Official Assignee's interlocutory application was dismissed.
