Although the contracts in dispute were illegal under the Gaming Act 2003, the Court exercised its discretion under r 14.11 to award Manukau scale costs because objectively the Calderbank offers (including a $50,000 offer) would have left Shoye in a better position than the trial outcome and encouraged settlement; however, Manukau's conduct in attempting to present illegal arrangements as legal disentitled it to any uplift, so only scale costs and reasonable disbursements were awarded.
