The Court found ACC failed to satisfy s107(3) because the IRP's critical component (an appropriate graduated work trial) was not meaningfully completed and the VIMA failed to adequately assess pain as an injury-related barrier to sustaining 30 hours per week; contrary expert evidence was persuasive. Consequently the vocational independence decision was unlawful and set aside.
