Because the respondent had been ordered to produce the original will, had failed to do so despite repeated requests and service of an order nisi, and more than three months had elapsed since the testatrix's death, the court was satisfied to grant probate of the copy will to the applicant alone, conditional on production of the original if subsequently found.
