The 14 October 2002 letter created a sufficiently arguable contractual commitment by the defendants to enter the plaintiff's Grower Agreement and supply the grapes; damages would not adequately compensate the plaintiff given its reliance and commercial gearing; on balance of convenience the risk of ultimate injustice favours granting interim relief; accordingly mandatory interim injunctions were appropriate to restrain sale and to compel access for harvest, with costs awarded to the plaintiff.
