Balance of factors favoured an order for costs to the Verschaffelts on 2B scale because (a) the Verschaffelts' statement of assets was misleading but (b) SH Lock delayed in withdrawing the caveat after the trust interest was evidenced; therefore costs awarded on scale without uplift or indemnity.
