The Court ordered rectification of the Agreement to reinstate the defendant's personal guarantee, held the defendant liable under that guarantee for ERP's outstanding rent and outgoings of $53,859.62 with contractual default interest and solicitor/client costs, and held the defendant personally liable in trespass for moving and abandoning the waste bales on plaintiff's land, awarding removal costs of $2,831,007.90 and awarding loss of rent of $92,288.70 with the GST issue on that item reserved.
