The father had detained the children by taking them to New Zealand and refusing to return them contrary to the signed agreement that their permanent residence was Abu Dhabi; he did not establish lawfulness of that detention and, under s14(1) of the Habeas Corpus Act, the High Court was required to issue a writ ordering their return to Abu Dhabi rather than transfer the matter to the Family Court given urgency and children's welfare concerns.
