Court had jurisdiction to grant interim relief under s 15 JRPA but declined relief because it was not reasonably necessary to preserve the applicant's position: the present regulatory position would remain for about 10 months, decision-making committees retain capacity to extend implementation time or address lead‑time issues, alternative remedies (appeals, later applications for interim relief) exist, the applicant had delayed in challenging the 2010 decision and had not addressed service/participation of interested parties, and on balance the discretion favoured refusal of interim orders.
