The plaintiff lacked standing to bring the claim because she was not an executor, administrator or beneficially interested party in the estate as pleaded; independently, the claim was time-barred under Limitation Act 1950 s4(1)(a) because the cause of action accrued on the insured's death on 18 April 2006 and no pleaded policy term or statutory exception validly extended or postponed the limitation period; accordingly the review is dismissed and the proceeding struck out.
