Although the Bank was successful on the leave and substantive applications, the leave application was procedurally defective and indulgent (filed after the summary judgment application, non‑compliant notice, no affidavit explaining delay) and therefore the costs incurred in relation to the leave application were unnecessary; accordingly costs for the leave application are disallowed while the Bank is awarded costs and disbursements for the substantive proceeding ($17,686 and $3,287.50 respectively).
