Rule 8.4 applies to plaintiffs who commence proceedings with a summary judgment application; r 12.4(4) does not exclude r 8.4; r 8.4(7) prevents unnecessary duplication of documents already exhibited in affidavits; the mischief/purposive approach did not justify reading down the clear words of r 8.4; plaintiff must complete initial disclosure within 10 working days and is liable for costs awarded for the disclosure dispute.
