The counterclaim defendants were entitled to 2B costs and most disbursements as they were specific to and reasonably necessary for the conduct of the proceeding; the court approved costs of $27,007 and disbursements of $2,117.68, but directed the Registrar to exercise HCR 14.12(2) concerning verification and any adjustment of the meals claim for 24–27 April 2023.

Disbursements were awarded only where they met r14.12: filing and scheduling fees, photocopying, courier and the doctor's consultation and affidavit preparation were specific to and reasonably necessary for the appeal and reasonable in amount (the doctor's affidavit was determinative). Disbursements that predated the appeal, related to substantive proceedings, concerned travel not ordinarily claimable, or were payments to non-lawyers (online services) were refused.

The claimant seeking a disbursement must prove the amount is reasonable; where the quantum is significant the court may expect independent supporting affidavit evidence but may adopt a pragmatic approach and quantify a reduced award based on available material (including write‑offs, effective hourly rates, expertise and urgency). Applying those principles the court reduced the claimed ¥298,000 to ¥198,000 as a reasonable award.

Expert fees were recoverable under r14.12 because the expert evidence was specific to and reasonably necessary for challenging the adequacy of MBIE's investigation given limited cooperation; the claimed amounts were reasonable in the circumstances; however portions of the evidence from two experts exceeded the proper scope for judicial review and recovery of those fees was reduced by 25%, resulting in an award of $90,136.03 for expert fees to the applicant.

Costs awarded to the Attorney‑General. Preparation of evidence was properly categorised as Band C and allowed at five days at the category 2 daily rate ($1,990). The claim for second counsel was disallowed for lack of detail as to role and necessity. Travel and accommodation disbursements were recoverable but reduced by 50 percent because of the disallowance of second counsel. Total award for costs and disbursements is $31,416.72.

The Court held that Dr Knight, as a successful lay litigant in judicial review, was entitled to recover proper and reasonable disbursements under r14.12: the defendants' offered disbursements subject to verification are recoverable; fees paid to Blomkamp Cox ($1,786.50) and any other legal advice demonstrably related to the proceedings are recoverable; airfares for persons acting as McKenzie friends for hearings where they performed that role are recoverable; lost wages are not recoverable; adjournment costs not attributable to a party are not awarded.
