Ms Sax's repeated rejection of reasonable settlement offers, combined with her conduct in bringing unmeritorious proceedings and applications that substantially increased costs, constituted exceptional circumstances under s45(3)(e) Legal Services Act 2011; having regard to her means the court limited her personal liability to a nominal sum of $1,000, and the trustees of the Trust were ordered to pay half of the plaintiff's assessed scale costs and disbursements, being $20,638.60.

Because the respondents collectively presented an identical, unified opposition to a single, administratively efficient transfer and consolidation application and acquiesced to that approach, and there was no timely or arguable basis to object that would justify departing from the default rule, the court applied High Court Rules r14.14 and ordered joint and several costs against the respondents.

MACPHERSON v NAPIER CITY COUNCIL [2014] NZHC 305

The Court found both respondents bore some responsibility for the defects that led to the consent being set aside and that a fair and reasonable apportionment was to split costs equally; accordingly awards were made to the applicants with costs apportioned 50% against each respondent and disbursements shared equally and severally.
