Ms Sax's repeated rejection of reasonable settlement offers, combined with her conduct in bringing unmeritorious proceedings and applications that substantially increased costs, constituted exceptional circumstances under s45(3)(e) Legal Services Act 2011; having regard to her means the court limited her personal liability to a nominal sum of $1,000, and the trustees of the Trust were ordered to pay half of the plaintiff's assessed scale costs and disbursements, being $20,638.60.
