Applicants failed to establish they were prejudicially affected so as to justify rescission under r 17.44; respondent was entitled to incur and recover the costs and expenses of obtaining the charging orders under r 17.25; the charging orders therefore remain in force to secure the unpaid enforcement costs and filing fees totaling NZD 1,834.50.
