Because the defendant's application to set aside the statutory demand was filed prior to the plaintiff's statement of claim and the Court had extended time for compliance, the plaintiff could not at present rely on non-compliance with the demand to justify publication of a liquidation advertisement; accordingly an interim order restraining publication was justified and the matter was adjourned to the date fixed for determination of the set-aside application.
