The court sentenced the defendant to four months' home detention on each of three conspiracy charges, to be served concurrently with each other and concurrently with the defendant's existing 12 months' home detention imposed 14 January 2022; the new home detention is to be served at the same address and on the same terms and conditions as the earlier sentence.

The non-association special condition was rationally connected to the statutory purposes in s 80D(2), was necessary because standard conditions were inadequate given the real risk of reoffending against the same victim, and its limitation on freedom of association was justified; accordingly the sentence was not manifestly excessive and the appeal is dismissed.

By consent, the Court supplemented Mr Smith's special conditions of home detention to (1) prohibit access to the internet or possession of internet-capable devices without the prior written approval of a probation officer and (2) require production of electronic devices for inspection on request by a probation officer or their agent.
