The Court dismissed the appeal because ACC lawfully exercised its discretion: there was no contemporaneous medical evidence that the 2006 home modifications were required as a direct consequence of the covered meningitis; the assessor and Branch Medical Adviser concluded the works addressed psychological needs rather than an injury-related physical need; mental injury cover did not apply at the time of the works; alternatives for isolation existed; and ACC was not shown to have made an error of law or irrational decision.
