Applying rr 12 and 13 of the Senior Courts (Access to Court Documents) Rules 2017, the Judge balanced open justice against confidentiality and commercial sensitivity, gave weight to the ICSID confidentiality regime and the limited disclosure under Article 54, and concluded that disclosure was not necessary for the administration of justice and would undermine confidentiality and the ICSID consent‑based procedures; access was therefore refused.
