On the evidence, including specialist opinions that the appellant remained symptomatic and could not return to his pre-accident full duties as a book binder, and having regard to limitations of imaging and the corrected history considered by Dr Martin, the Court found the appellant remained incapacitated for his pre-injury employment within s37A and revoked the Corporation's decision to cancel weekly compensation.
