The application was dismissed because the applicant failed to satisfy the cumulative requirements of r 8.20: he did not demonstrate a real probability of a viable defamation claim against identifiable persons requiring additional documents, he did not show it was impossible or impracticable to formulate his claim without further documents, and the disclosed materials (and the University's Privacy Act compliance) did not provide reasonable grounds to believe further relevant documents were in the respondents' control; consequently an order for pre-commencement discovery was not necessary.
