The written guarantee complied with s 27 Property Law Act 2007, Eagle defaulted and the Commissioner gave written notice of cancellation as required by the deed; Mr Wright failed to pay the guarantor sum within the contractual period, therefore on proof by affidavit judgment is entered for the Commissioner for $414,317.00 with interest from the statement of claim and costs awarded.
