On the balance of probabilities the respondent engaged in significant criminal activity and knowingly derived an unlawful benefit of not less than $50,000 and has an interest in the 2018 Nissan Navara; therefore a profit forfeiture order under s 55 of the Act must be made specifying the assessed benefit and the property to be realised.

On the balance of probabilities the uncontested and corroborated police evidence established that the respondents were engaged in the sale and supply of cannabis, the $10,900 seized was unexplained and linked to the respondents, and the respondents had interests in that cash; therefore a profit forfeiture order must be made under s55 CPRA.

Commissioner proved on the balance of probabilities that both respondents unlawfully benefited from significant methamphetamine supply activity and the statutory presumption of value in the application ($96,920) was unrebutted; respondents had interests (effective control) in the identified motorcycles and vehicle; therefore the Court was obliged under s55 to make profit forfeiture orders specifying the listed property to be realised and applying proceeds up to the maximum recoverable amount of $96,920.
