The Court held that the mother established grounds for interim placement of the two younger children under the Court's guardianship because they are New Zealand nationals, existing Family Court parenting orders required their return and the father was refusing to comply; because India is not a Hague signatory the appropriate remedy was guardianship to facilitate return, and the circumstances justified making the orders without notice.
