The balance of convenience favoured refusing the interim injunction because Wood Bay was in default and likely insolvent, its appeal rights were unlikely to be rendered nugatory before the appeal could be heard if prosecuted expeditiously, and granting the injunction would cause significant and irrecoverable harm to the respondents and third parties while Wood Bay had little prospect of satisfying an undertaking as to damages.
