The Court concluded the Council's cancellation of the library booking, conditioned on the Council arranging opposing speakers, was an unjustified and irrational limitation of SUFW's BORA-protected rights to freedom of expression and peaceful assembly; there were no demonstrated safety risks or other lawful bases sufficient to justify the limitation, and interim relief under s15 was necessary to preserve the applicant's position, therefore the licence to occupy continues in force.
