An interim suppression order under s292 should be granted where the applicant has filed within the Court's specified timeframe and respondents do not oppose, so as not to deny the Supreme Court the opportunity to consider an intended application for leave to appeal; the court will exercise its discretion to preserve suppression pending the filing deadline (s291(2)).

The application for an interim suppression order was dismissed because, although publication was likely prejudicial to FISL, the prejudice was not of sufficient weight to overcome the high threshold for non‑publication given (a) the judgment was already in the public domain, (b) the decision was interim and made without notice, and (c) the public interest in disclosure and opportunity for FISL to present its case meant suppression was not justified.

The Court exercised its discretion under s 292(2) to grant an interim suppression order because it could not exclude the possibility the Supreme Court would grant leave on the formulated issues; the court cannot impose additional timing conditions that would conflict with the statutory duration set out in s 292(3); the suppression extends to name, address, occupation and identifying particulars and details of earlier offending until the statutory events occur, but does not prevent publication that the Crown seeks or the judge imposes or declines preventive detention.
