The Court refused to recall the previous costs decision and upheld the $8,671 award because: on appeal the High Court appeal allocations in Schedule 3 apply; the 'preparation of case on appeal' item may be claimed without a specific common bundle or points on appeal where counsel has undertaken preparatory work; the hearing in fact occupied approximately half a day validating the half‑day allowance; and recall was inappropriate because the respondent had the opportunity to raise these points earlier and recall is not a mechanism to re-litigate settled matters.
