Medical imaging and specialist evidence established that the claimant's symptoms were accounted for by pre-existing multi-level degenerative cervical disease (foraminal stenosis) such that the condition was substantially caused by a gradual/ageing process excluded by s26(2) and s26(4)(a); accordingly the revocation of ACC cover was upheld and the appeal dismissed.
